Dr Elisabeth Peden SC holds a First Class degree in law and the University Medal from the University of Sydney and a Ph.D. from the University of Cambridge. She is a Fellow of the Australian Academy of Law. As well as being a widely experienced Advocate, she is Professor of Law at the University of Sydney. Dr Peden is an acknowledged expert in Contract law throughout the common law world and a widely published author.
Elisabeth was admitted as a legal practitioner in 1994 and commenced practicing as an academic barrister in 1999 and as a full time barrister in 2007. She was appointed Senior Counsel in 2019. Elisabeth has a general commercial practice at the bar, regularly appearing in the Federal and Supreme Courts around Australia. She also appears in the High Court and various tribunals.
Her practice areas for litigation, arbitration and advice include appellate, commercial/contract, corporate and banking, construction, equity, property including strata, succession/family provision, medical/professional negligence.
Professor of Law
Elisabeth commenced as a lecturer at Sydney Law School in 1999 and was quickly promoted up to Professor in 2008. She teaches in LLB and JD subjects including Contract Law, Civil Procedure, Evidence, Interpretation. She also teaches LLM courses including Breach of Contract, Controlling Liability by Contract, Contractual Damages and Advanced Obligations.
Elisabeth has a general practice with particular specialty in commercial and contract law. She appears in all courts and tribunals, including NSW Court of Appeal and High Court. She has acted for individuals, small companies, large companies and governments, providing efficient and effective advice and legal representation in litigation.
Elisabeth has worked as a mediator / facilitator for over 10 years. She is a nationally accredited mediator and is on the NSW Supreme Court mediation panels. She has mediated many disputes in a variety of areas.
Trainer & Speaker
Elisabeth provides legal training to law firms and national corporations and is a regular invited speaker at national and international conferences on aspects of contract, commercial, evidence and procedure, and medical negligence law.
Elisabeth has written extensively on contract and commercial law. She is the author of more than 12 books and approximately 50 articles in international journals. Her work has been cited by courts in Australia and internationally.
